Terms of service

Plainly, how working with us works

These terms cover this website and the private client portal we run for some clients. They are meant to be read. If you have signed a separate agreement or statement of work with us, that document comes first wherever it says something different.

Who we are

Studio Lucky Bamboo is a sole proprietorship doing business as STUDIO LUCKY BAMBOO, based in Westminster, California. In these terms, “we” and “us” mean Studio Lucky Bamboo. “You” means the person or business using the site or the portal.

The website

You can read this site freely. We try to keep it accurate, but we do not promise it is always current or always available, and nothing on it is a guarantee of any result for your business.

The client portal

The portal is invite only. We create your access, and you may not share your login or let someone else use it.
You are responsible for what happens under your login. Tell us right away if you think someone else has your access.
You may use the portal only for your own business and the accounts you are entitled to manage. You agree not to try to see another client’s information, break or probe the portal, or use it to send spam or anything unlawful.

Connecting your social accounts

You may connect an Instagram, Facebook or LinkedIn account only if you own it or are authorized to manage it for the business.
Connecting an account lets us publish to it and read results for it, and only that. We publish nothing without a person approving that specific post first. Where the portal publishes, a person types a confirmation phrase naming the platform before anything goes out.
You can disconnect at any time in the platform’s own settings or by emailing us. How we handle the data is described on our Data deletion and Privacy pages.
Instagram, Facebook and LinkedIn each have their own terms and rules. You agree to follow them, and we follow them too. If a platform changes its rules or access and a feature stops working, we will tell you, and we are not responsible for the platform’s decision.

Your content and ours

What you give us, such as your photos, logo, words and account details, stays yours. You give us permission to use it only to do the work you hired us for, including publishing it where you approved.
You promise you have the right to give us that content, and that it does not break anyone else’s rights or the law.
The tools, templates and methods we use to do the work remain ours. What we create specifically for you under an agreement is covered by that agreement.

Fees

Fees, scope and timing are set in your agreement or statement of work, not on this page.

What we promise, and what we do not

We do careful work and we will fix mistakes we make. We cannot promise results such as a number of followers, visits or customers, because those depend on things outside our control, including the platforms. The site and portal are provided as they are.

Limits on our responsibility

To the extent the law allows, we are not responsible for indirect or lost-profit losses, or for losses caused by a platform, a service provider or something outside our reasonable control. Our total responsibility to you for any claim is limited to the fees you paid us for the work the claim is about in the 3 months before it arose. Nothing here limits anything the law does not allow us to limit.

Ending things

You can stop using the portal or disconnect your accounts at any time. We may suspend or end access if these terms are broken or if we stop offering the portal, and we will give notice when we reasonably can. When access ends, the deletion steps on our Data deletion page apply.

Changes

If we change these terms we change this page and the date below with it. If a change is significant, we will email clients who use the portal.

Which law applies

These terms are governed by the laws of the State of California.
